This Disclaimer applies to the use of the McDonald’s Nederland B.V. ("McDonald's" websites, apps (the "App") and social media accounts (collectively: "the Services"). By using the Services, you agree to the applicable conditions in this Disclaimer.

Intellectual Property Rights

All intellectual property rights and other property applicable to and/or used or depicted in the Services, including trademark, copyright and patent rights in, i.a. all texts, images, sounds and software, are held by (a group company of) McDonald's Inc. and/or by third parties from whom (a group company of) McDonald's Inc. has obtained a licence. The intellectual property rights or licences held by (a group company of) McDonald's Inc. are in no way (sub)licenced or transferred to third parties.

Any form of publication or copying/reproduction (in the broadest sense of the word), any use of a copy, or the reproduction or dissemination of (part of) the contents of the Services other than for personal, non-commercial use, is strictly forbidden, unless McDonald's has given prior written consent.

The prohibition on disclosure includes a prohibition on distributing, disseminating and/or making available the Services in any manner whatsoever.

The prohibition on reproduction includes any use of a (non-personal) copy or reproduction of (part of) the contents of the Services. (Part of) The Services include (but are not limited to) all (video or photo) images, logos, text or other material visible when using the Services. Use of (part of) the data displayed on the Services or of the Services on a website or otherwise is also forbidden. It is not permitted to adapt or amend (part of) the contents of the Services of McDonald's.

The App is free to download from the App Store and Google Play Store. By downloading the App, you obtain a non-exclusive and non-transferrable right to use the App on a device with an IOS (iPad/iPhone) or Android operating system that you own. You cannot tether the App to a network that allows other devices to use the App. Moreover, you cannot disassemble or decompile the McDonald's App or submit it to reverse engineering or seek to discover the source code of the software of the App.

Liability

McDonald's will do its best to ensure as far as possible that the Services are virus-free, but unfortunately cannot guarantee this. Therefore, McDonald's does not guarantee the security of the Services. Nor can McDonald's guarantee that the Services will function without error or interruption.

McDonald's excludes any liability for damage arising as a result of McDonald’s, its employees and non-employees downloading and/or using the Services, unless such damage is the direct result of wilful intent or gross negligence on the part of McDonald's, its employees or non-employees. This includes (but is not limited to) damage resulting from viruses, computer fraud and damage to hardware or software. McDonald's also excludes any liability for damage originating or caused as a result of errors and/or gross negligence on the part of its employees or non-employees. Therefore, use of the Services is entirely at your own expense and risk. The user of the Services is aware that there are certain risks involved in downloading and/or using the Services.

McDonald's makes every effort to keep the information provided on the Services as current as possible. Notwithstanding, it is possible that information on the Services does not (no longer) correspond with reality. McDonald's accepts no liability whatsoever for such inaccuracies or omissions and cannot be held liable for any damage suffered as a result thereof. McDonald's does not guarantee the security of its Services.

McDonald's is not liable and/or responsible for (the content of) third-party websites to which the visitor gains access via any ‘hyperlinks’ present on McDonald's Services. The participant and/or visitor of the Services is aware that internet use entails certain risks.

From time to time, the Services may be updated. The current privacy statement was updated on 6 October 2016. If you find any errors in the Services, McDonald's would greatly appreciate it if you would report them by sending an email to [email protected].

Amendments

McDonald's reserves the right to amend these terms and conditions. McDonald's advises you to install every update of the App or visit the McDonald's website, so that you always have the most recent version of these terms and conditions.
